THE USER

Any person having access to the Site, regardless of their status (private individual or professional), their location, the means of connection to the Site, the purpose and aim of their access to the information published on the Site, is a User of the Site.

The user is informed of the risks inherent in the Internet, particularly in terms of :

– security flaw in data transmission ;

– continuity not guaranteed in access to the Site or to the various services offered by the Site.

Under no circumstances will the Publisher be held responsible for these risks and their consequences, whatever their extent, for the User.

It is the responsibility of each User to take all appropriate measures to protect their own data, software and hardware from contamination by viruses or other forms of attack that may circulate via the Site or the information published.

The User may not take advantage of any difficulty in accessing the Site to access information in breach of these General Conditions of Use. In order to be taken into account, the User's complaints must be sent to the Publisher by post only, by registered mail with acknowledgement of receipt, to the above address.

AUTHORIZED USES

The Site and the information published on it are reserved:

  • consulting information using the Publisher's automated data processing system;
  • for uses strictly reserved for the private, non-commercial use of the User and not intended for collective use, whether free of charge or for a fee.

The creation of links pointing to pages on the site is tolerated insofar as these pages can only be opened in a new browser window. In any event, the Publisher reserves the right to terminate this tolerance at any time if it considers that the link established with the Site is likely to harm the interests of the latter.

The User is legally entitled to make short quotations, analyses and reproductions for press reviews, as well as other uses expressly authorized by law, within the limits and conditions set by the latter, and subject in particular to quoting the names of the authors and the editorial source.

PROHIBITED USES

Unless expressly authorized in advance by the Publisher, all reproductions, representations and uses other than those referred to above are prohibited, in particular:

  • any adaptation, making available to the public at its request or not, distribution, rebroadcasting in any form whatsoever, networking, public communication of all or part of the works, services, trademarks and all elements protected or likely to be protected by intellectual property law reproduced on the Site;
  • any extraction or reuse, including for private purposes, of a substantial part of the content of the databases constituted by the Site;
  • any repeated and systematic extraction or reuse, including for private purposes, of even an insubstantial part of the content of the databases constituted by the Site;

– any link, access, modification, addition or deletion that affects the online edition's automated processing system and modifies the publication conditions or editorial policy.

FRAUDULENT BEHAVIOR

Any User acting in breach of these General Terms of Use is liable to civil or criminal prosecution, in particular for infringement of copyright, neighboring rights, the rights of database producers and automated data processing systems. The User is reminded that the French Penal Code (article 323-1 et seq.) provides for penalties of up to five years' imprisonment and a fine of 75,000 euros, in particular for :

– fraudulent access to and maintenance of an automated data processing system,

– fraudulent deletion, modification or addition of data to this system,

– hindering this system,

The Publisher may institute criminal proceedings against any User who fails to comply with these provisions.

RESOURCES DEPLOYED TO COMBAT ILLEGAL ACTIVITIES

All Users acknowledge that they have been informed that a posteriori moderation is implemented to control, delete or modify content published by members of the Interactive Services which appears to be contrary to current laws and regulations, or which has been reported as such by the judicial authorities. All Users acknowledge that they have been informed that an alert system is available at all times to any person wishing to report the publication on the Interactive Services of any message of a litigious nature of which they are aware, in particular those which fall within the scope of the offences provided for in articles 24 paragraphs 5 and 8 of the French Press Act and 227-23 of the French Penal Code, such as the defence of crimes against humanity, incitement to racial hatred, child pornography, in accordance with the provisions of article 6 - I - 7. paragraphs 3 and 4 of the French Law on Confidence in the Digital Economy of June 21, 2004.

It is understood that any abuse of this right is liable to engage the responsibility of the person exercising it. In particular, the following may give rise to legal proceedings:

  • the fact of reporting a message or an activity as being illicit with the sole aim of obtaining its withdrawal or stopping its distribution, while knowing that this information is inaccurate, the denunciation, made by any means of communication including by electronic means and directed against a specific person, of a fact which is likely to lead to legal sanctions, and which is known to be totally or partially inaccurate.

SITE ADMINISTRATOR

The role of the Site administrator is to guarantee the proper operation of the Site and to ensure its security. It is part of his mission to facilitate the application of the present Terms and Conditions of Use and to ensure the loyal and responsible behavior of each User.
